CONSTITUTION OF YOUTH for SWARAJ

ARTICLE I: NAME, SYMBOL, SLOGAN, AND FLAG

  A. NAME:

    The name of the Organization shall be 'Youth for Swaraj'.

  B. SYMBOL:

    Y4S - English alphabet ‘Y’ in Red-Blue colour followed by numerical ‘4’ in Blue colour and English alphabet ‘S’ in Red colour.

  C. SLOGAN:

    Hum... Hain!

  D. FLAG:

    Colour: White-Yellow (2:4 ratio), Shape: rectangular (3:2 ratio) in length and breadth. White symbolises ‘Positivity and Purity’, Blue symbolises ‘Social Justice’, Yellow symbolises ‘Energy and Enlightenment’, and Red symbolises ‘Revolution’.

ARTICLE II: MEMBERSHIP:

  A. ELIGIBILITY:

    Any person between 14 to 35 years of age who accepts the objectives and principles of Y4S and pays an annual membership fee of Rs.10/- can, by filling up the prescribed form, enroll himself or herself as a member of Y4S. Provided that he/she should not be a member of or associated with any organization whose views, objectives, policies or actions are inconsistent with the underlying objectives and founding principles of Y4S.

  B. TERM:

    The term of membership, subject to renewal, termination or resignation, will be 1 year. Provided that for the purpose of this clause, a year will be taken as the period commencing from 1st of April of a calendar year to the 31st of March of the succeeding year.

  C. RIGHTS AND DUTIES OF A MEMBER:

    I. Members have the right to elect and get elected.

    II. Members will have the right to cast only one vote per member.

    III. Members shall not indulge in activities which are prejudicial to the aims and objectives and/ or the rules and regulations of the Organization

    IV. Members have to pay an annual membership fee/ renewal fee of Rs. 10/- (Rupees Ten only)

    V. Individuals and institutions will have to get their membership renewed every year during the period fixed by National Coordination Committee.

  D. CESSATION OF MEMBERSHIP:

    I. Death of the member

    II. Resignation from membership

    III. Non-renewal of membership

    IV. Suspension or termination as a result of disciplinary action taken by the Disciplinary Committee.

    V. On completion of -35-years of age unless otherwise approved by Student Coordination Committees and/or Youth Coordination Committees subject to final approval of National Coordination Committee.

  E. DISCIPLINARY COMMITTEE:

    I. If a member is found indulging or to have indulged in any activity which is prejudicial to the aims and objectives and/or the rules and regulations of the organization, pending inquiry, his/ her membership can be suspended by the Disciplinary Committee.

    II. Prior to any action by the Disciplinary Committee, the Disciplinary Committee shall first serve the member concerned with a show-cause notice showing therein the charges framed against him and ask him to submit his statement of defense within 15 days of the issue of show-cause notice. On receipt of the explanation within the set time frame, the committee shall have the power to take a suitable action against the concerned member. In case no reply to the show-cause notice is received within 15 days, the committee shall decide the matter in accordance with principles of ‘justice, equity and good conscience’

    III. The decision of the Disciplinary Committee shall be communicated to the member(s) concerned.

    IV. The member concerned shall have the right to appeal before the NC and the decision of the NC shall be final.

ARTICLE III: STRUCTURE AND ORGAN:

  A. National Cabinet (hereinafter referred to as ‘NC’):

    I. It shall be the highest policy making body of the Organization.

    II. All members nominated by ‘University Cabinet’ and ‘State Youth Cabinet’ will together form National Cabinet (NC).

    III. National Working Committee (NWC) of Swaraj Abhiyan can nominate 10 members to NC.

    IV. The NC may invite anyone from within or outside the organization to attend its meetings as a ‘Special Invitee’ who can participate in discussions but will not have any voting rights.

    V. NC shall meet at least once in every calendar year.

  B. University Cabinet (hereinafter referred to as ‘UC’):

    I. All office bearers of university will together form the UC. Every UC can nominate one member to NC.

    II. (a) Every college/campus having -30- or more members shall elect its Office Bearers - President, General Secretary and Joint Secretary. All office bearers of the colleges/campuses as well as the all students of the university departments shall elect university’s Office Bearers - President, Vice President, General Secretary and Joint Secretaries.

    II. (b) Every University with single campuses (for e.g. JNU/BHU/University of Hyderabad) having -30- or more members shall elect its Office Bearers - President, Vice President, General Secretary and Joint Secretaries.

    III. On rotational basis, in alternate years, either the General Secretary or the Joint Secretary shall be a woman.

  C. State Youth Cabinet (hereinafter referred to as ‘SYC’):

    I. Office bearers of every district will together form the State Youth Cabinet (SYC). They will elect their office bearers. Every SYC can nominate two members to NC.

    II. Every district where there are more than -30- members, the members shall elect their office bearers – President, General Secretary and Joint Secretary. A youth member, other than the office bearers of the District Committee of Swaraj Abhiyan can contest such elections.

    III. On rotational basis, in alternate years, either the General Secretary or the Treasurer shall be a woman.

ARTICLE IV: OFFICE BEARERS

  There will be a President, Vice President, General Secretary, Joint-Secretary and a Treasurer in the organization. The President and the General Secretary will represent the organization.

ARTICLE V: POWERS AND FUNCTIONS OF OFFICE BEARERS

  A. PRESIDENT:

    I. The President will be in charge of functioning of the Y4S at the concerned level.

    II. President at the concerned level will facilitate and organize meetings of the Unit.

    III. President at the concerned level will implement and execute decisions of the respective committees and carry out all such work as assigned from time to time.

    IV. The President shall preside over, conduct and regulate the meetings of the National Convention and National Cabinet, held after his election.

    V. The President shall advise the General Secretary in matters requiring urgent attention.

  B. VICE-PRESIDENT

    I. The Vice-President shall enjoy all the powers of the President in his absence.

  C. GENERAL SECRETARY:

  The General Secretary shall:

    I. Be responsible for managing the day to day affairs of the Secretariat at the concerned Level

    II. Prepare the list of the members and maintain the minutes of meetings conducted by the office.

    III. Be responsible for issuing general circulars and notices.

    IV. Maintain all documentation and communication related to the organization.

    V. Prepare the annual report of the organization.

    VI. Sign and execute all the papers and documents on behalf of the organization and in the interest of the organization, file suit or defend any suit and/or any legal matter.

    VII. Perform all duties incidental to his office.

  D. TREASURER

  The Treasurer shall:

    I. Keep under his care and management the assets and funds of the organization.

    II. Collect and receive all sorts of donations and grant receipts thereof.

    III. Maintain and keep cashbook, income and expenditure and such other accounts as per necessity.

    IV. Operate bank accounts jointly either with the signature of the President or the Vice-President or the General Secretary (any two)

    V. Prepare the budget in consultation with the General Secretary and the President.

ARTICLE VI: TENURE OF THE OFFICE BEARERS AND LIMITATIONS

  A. The tenure of office bearers and members shall ordinarily be of one year.

  B. If any Committee member or office bearer at concerned level is elected or nominated to any other position in the organization, he/she shall resign from the position of President, General Secretary or Committee member as the case may be, immediately

ARTICLE VII: POWERS AND FUNCTIONS OF NC:

  A. To prepare and execute detailed plans and programs for the organization

  B. To draft, adopt, amend, vary or rescind, from time to time, the rules and by-laws for the working of the organization.

  C. To supervise, direct and regulate SYC and UC and the Management Committee of National Convention.

  D. To issue instructions in accordance with the Constitution and rules in all matters, unless otherwise provided for.

  E. On failure of any committee to function within the scope of the Constitution or in accordance with the directions of the NC, the latter may suspend the existing committee and form an ad-hoc committee to carry on the work of Youth for Swaraj in that area.

  F. Any question or dispute arising under the Constitution between any members and/or committees shall be determined by the NC and its decision shall be final and binding.

  G. To prepare and maintain accounts, other relevant records and annual statement of accounts including the balance sheet of the organization.

  H. To open and operate bank accounts.

ARTICLE VIII: POWERS AND FUNCTIONS OF SYC AND UC:

  A. To prepare and execute detailed plans and programs regarding issues that concern the youth and the students.

  B. To execute the work programs and list of activities submitted by the NC.

  C. To prepare and maintain accounts, other relevant records and annual statement of accounts including the balance sheet of the organization

  D. To perform such additional functions and to carry out such duties as may, from time to time, be assigned to it by the organization.

ARTICLE IX: ALL INDIA CONVENTION

  The National Cabinet has the right to call for an All India Convention (AIC) of Youth for Swaraj for issues concerning the youth of the country, at a time and place mutually decided upon by the members of the NC. The AIC can be called by the NC, suo moto or on the recommendation of SYC or UC.

ARTICLE X: MISCELLANEOUS

  A. FUNCTIONAL AUTONOMY: Every Unit/Committee will have functional autonomy with respect to issues at the level of and arising from the area for which it is constituted. Provided, that SYC and UC may intercede on issues concerning more than one state and university respectively.

  B. QUORAM: The quorum for the meeting of all committees of the Youth for Swaraj shall be 1/3rd of the number.

  C. AMENDMENT: The Constitution shall be amended, altered or/added to only by the NC with 2/3 members present and voting in accordance with the system of proportional representation.
